1. Acceptance of these Terms
These Terms of Use ("Terms") govern your use of the website at americaeire.org and any related pages, content, or services (collectively, the "Site"). By accessing or using the Site, including by submitting a story or other content, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the Site.
2. Purpose of the Site
The Site is operated by Irish America 250 as part of a nonpartisan, national initiative to honor and celebrate the contributions of Irish and Irish Americans to the United States. The Site invites members of the Irish diaspora to tell their Irish story and to contribute to a collective digital time capsule documenting Irish America at this historic moment.
3. Use of the Site
You may use the Site only for lawful purposes and in ways consistent with these Terms.
You agree that you will not:
- Use the Site in any way that violates applicable local, national, or international laws or regulations
- Submit content that is defamatory, hateful, harassing, unlawful, or that infringes the rights of others
- Attempt to gain unauthorized access to the Site, its systems, or the information of other users
- Use any automated means (such as bots or scrapers) to access or collect data from the Site without our prior written permission
- Interfere with or disrupt the operation of the Site or any servers or networks connected to the Site
We reserve the right to suspend or terminate your access to the Site if we believe you have violated these Terms.
4. Intellectual property
Unless otherwise indicated, the Site and its content, including text, images, graphics, logos, and design elements, are owned by or licensed to Irish America 250 and are protected by copyright and other intellectual property laws.
You may use the Site and its content for personal, noncommercial, informational purposes only. You may not reproduce, distribute, modify, publicly display, or create derivative works based on the Site's content without our prior written consent, except as otherwise permitted by law.
Nothing in these Terms grants you any ownership rights in the Site or its content.
5. Story submissions and user content
5.1. What you may submit
The Site may allow you to submit:
- Written stories
- Photographs or other images
- Audio or video content
- Other materials related to your family's Irish and Irish American experiences
Collectively, we refer to this as "User Content."
5.2. Your responsibilities
By submitting User Content, you:
- Confirm that the content is your own work or that you have obtained all necessary rights and permissions to submit it
- Confirm that, to the best of your knowledge, the content is truthful and does not knowingly misrepresent other people or events
- Confirm that the content does not infringe any copyright, trademark, privacy, publicity, or other rights of any person or entity
- Confirm that, where your submission includes identifiable images or information about living individuals, you have their consent (or that of a parent or guardian, where applicable) to share that information and for it to be used in the ways described in these Terms and in our Privacy Policy
- Agree not to include highly sensitive or confidential information that you or others would not want publicly shared or preserved
5.3. License you grant to us
By submitting User Content, you grant Irish America 250 a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to:
- Use, reproduce, modify (for example, for clarity, length, or formatting), adapt, translate, publish, display, perform, and distribute your User Content, in whole or in part
- Incorporate your User Content into other works and materials
- Use your User Content in connection with the Site, our social media channels, email communications, video or audio content, public programs, exhibitions, educational materials, and other mission-related activities
- Store and preserve your User Content as part of our digital time capsule or archival record
This license continues for as long as the User Content forms part of our archives or public materials, even if active promotion of the campaign ends.
Where practical, we will use reasonable efforts to credit you in a manner consistent with the project's format and editorial standards (for example, using your name, initials, or another form of attribution agreed at the time of submission).
5.4. Editorial discretion
We are not obligated to publish every submission we receive. We may:
- Review, edit, or decline to publish User Content at our discretion
- Edit submissions for clarity, length, or format while seeking to preserve the essential meaning of your story
- Remove or disable access to previously published User Content if we believe it is appropriate to do so (for example, if it is reported as inaccurate, harmful, or infringing)
6. No obligation to retain or return material
While the project aims to create a lasting record, we do not guarantee that any particular User Content will be preserved or remain accessible indefinitely.
We are not obligated to return any materials submitted to us and may, at our discretion, destroy, archive, or continue to publish User Content in accordance with our mission and legal obligations.
7. Third-party links and platforms
The Site may contain links to third-party websites, social media platforms, or services that are not controlled by Irish America 250. We are not responsible for the content, policies, or practices of any third-party sites or services, and your use of them is at your own risk.
When you share your story on external platforms (for example, by posting a link or sharing a campaign hashtag), your use of those platforms is governed by their own terms and policies.
8. Disclaimer of warranties
The Site and its content are provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied.
To the fullest extent permitted by law, Irish America 250 disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
We do not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site or the servers that make it available are free of viruses or other harmful components.
9. Limitation of liability
To the fullest extent permitted by law, Irish America 250, its officers, directors, staff, volunteers, and partners will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of the Site or any content, even if we have been advised of the possibility of such damages.
To the extent permitted by law, our total liability for any claims arising from or related to the Site or these Terms will be limited to the amount, if any, you have paid to us in connection with your use of the Site during the twelve (12) months preceding the event giving rise to the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Irish America 250 and its officers, directors, staff, volunteers, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way related to:
- Your use of the Site
- Your User Content
- Your violation of these Terms or any applicable laws
- Your infringement or violation of any rights of another person or entity
11. Governing law
These Terms and any disputes arising out of or related to them or to your use of the Site will be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws rules.
You agree to submit to the exclusive jurisdiction of the state and federal courts located in New York for the resolution of any disputes.
12. Changes to these Terms
We may update these Terms from time to time to reflect changes in our practices, the Site, or applicable laws. When we do, we will update the "Last updated" date at the top of this page.
Your continued use of the Site after any changes are posted constitutes your acceptance of the updated Terms.
